Judge: Mayor can proceed with SWAT raid lawsuit
UPPER MARLBORO, Md. (AP) - A judge has ruled that a small-town mayor whose two dogs were shot to death in a raid on his house can proceed with his lawsuit.
Prince George's County Circuit Judge Arthur M. Ahalt on Friday denied motions by the county and the state of Maryland to dismiss Cheye (shy) Calvo's lawsuit.
A SWAT team raided Calvo's home in July 2008 after smugglers sent a package containing 32 pounds of marijuana to his residence. Officers shot and killed the family's two Labradors.
Police later cleared Calvo and his family of any wrongdoing and said the delivery was likely part of a scheme in which smugglers send drug packages to unsuspecting people. The smugglers try to pick up the packages before residents bring them inside.
Calvo is mayor of Berwyn Heights, a Washington suburb.
