EFF, ACLU Sue Government Over Warrantless Electronic Searches At The Border

If all goes well, we might have the US border join the rest of the United States in recognizing citizens' Fourth Amendment rights. The Supreme Court's Riley decision made it clear law enforcement needed to obtain warrants before searching people's cellphones. Unfortunately, the so-called "border exception" -- upheld by at least one court -- says securing the border is more important than recognizing people's rights.

The EFF and ACLU -- along with the 10 US citizens and one permanent resident they're representing -- are suing DHS, CBP, and ICE for violating the Constitutional rights of the plaintiffs by warrantlessly searching their devices. Not only did the government search their devices, but in some cases, held onto the devices for weeks. One plaintiff's phone is still in the hands of the CBP, having originally been taken from the plaintiff in January.

One of the most important stories of the week was a long one from the AP about some shenanigans in the several states. Ordinarily, I’d leave this for our semi-annual weekly survey of what’s goin’ down there, but, frankly, this one covers too much territory not to be examined on its own. There is a concerted effort across the country to shut down sources of public information within state governments.

Lawmakers across the country introduced and debated dozens of bills during this year’s legislative sessions that would close or limit public access to a wide range of government records and meetings, according to a review by The Associated Press and numerous state press associations. Most of those proposals did not become law, but freedom-of-information advocates in some states said they were struck by the number of bills they believed would harm the public interest, and they are bracing for more fights next year.

C.I.A. Wants Authority to Conduct Drone Strikes in Afghanistan for the First Time

WASHINGTON — The C.I.A. is pushing for expanded powers to carry out covert drone strikes in Afghanistan and other active war zones, a proposal that the White House appears to favor despite the misgivings of some at the Pentagon, according to current and former intelligence and military officials.

If approved by President Trump, it would mark the first time the C.I.A. has had such powers in Afghanistan, expanding beyond its existing authority to carry out covert strikes against Al Qaeda and other terrorist targets across the border in Pakistan.

When a msm publication like the WSJ calls the unmasking "a clear felony" -- you know things are worse than bad!!
